Welcome to Guestavo (operated by Guestavo). By using our service, you agree to these terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using Guestavo, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.
2. Use of Service
Guestavo provides a web application platform. You may use our service only as permitted by law and in accordance with these Terms. We reserve the right to modify, suspend, or discontinue the service at any time without notice.
3. User Accounts
When you create an account with us, you must:
- Provide accurate and complete information
- Maintain the security of your password and account
- Promptly update your account information if it changes
- Accept responsibility for all activities under your account
You must notify us immediately of any unauthorized use of your account or any other breach of security.
4. Prohibited Conduct
You agree not to engage in any of the following:
- Using the service for any unlawful purpose or in violation of any laws
- Attempting to gain unauthorized access to any part of the service
- Interfering with or disrupting the service or servers
- Uploading or transmitting viruses or other malicious code
- Impersonating any person or entity
- Collecting or harvesting user data without consent
- Using the service to send spam or unsolicited communications
5. Intellectual Property
The service and its original content, features, and functionality are owned by Guestavo and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6. User Content
You retain ownership of any content you submit, post, or display on or through the service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the service.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the service will immediately cease.
8. Fees, currency and tax
All prices are stated in euro (EUR) and exclude VAT. Your subscription is charged in advance for each billing period, monthly or yearly, whichever you chose. Usage beyond the credits included in your plan is paid for in advance by buying credit packs. We never invoice you afterwards for usage you did not buy.
Who invoices you depends on how you pay. If you check out through a payment provider that sells in its own name (currently Paddle, Polar and Lemon Squeezy), that provider is the seller for tax purposes and issues your invoice. If you check out through Stripe or PayPal, Guestavo is the seller: we charge Slovenian VAT unless you give us a valid EU VAT identification number for a business established in another member state, in which case the reverse charge applies and you account for the VAT.
9. Trial, renewal and cancellation
Every paid plan starts with a free trial that lasts 7 days. If you do not cancel before the trial ends, the subscription begins and the first period is charged.
Your subscription renews automatically at the end of each billing period, at the price then in force, until you cancel. You can cancel at any time from your billing settings: no email, no phone call, no notice period, no reason required. Cancelling stops the next renewal. It does not refund the period you are already in.
Whether you keep your paid features until that period ends depends on how you pay. Through most providers you do. If you pay through PayPal or Lemon Squeezy, cancelling takes effect on the day you cancel and your paid features stop then, so if you want to use the whole period you have paid for, cancel on its last day.
10. Price changes
We may change our prices. If a change affects a subscription you already hold, we will tell you at least 60 days before it takes effect, by email to the address on your account. The new price applies from your first renewal after that notice period; nothing changes in the middle of a period you have paid for. If you do not want the new price, cancel before it takes effect.
11. Credits
Some actions are metered in credits: SMS, WhatsApp and other messages that a carrier charges us for, and AI menu scanning. Email is not metered and costs no credits. There are two kinds of credit and they behave differently:
- Included credits arrive with each paid billing period as part of your plan. They build up to at most 2 months of allowance, and each period’s credits expire 60 days after they are issued.
- Purchased credit packs are bought separately and expire 3 months after purchase. The expiry date is shown before you buy, and we warn you 14 days before it arrives.
Credits are a prepaid way of using Guestavo and nothing else. They are not electronic money, they have no cash value, they cannot be transferred or exchanged for cash, and unused or expired credits are not refunded except where we owe you a refund under the Refunds section or under mandatory law. Included credits are spent before purchased ones, and within each kind the credits expiring soonest are spent first, so you never lose a credit that could have been used.
A message your guest is owed, such as a booking confirmation or a reminder, is sent even when your balance is too low to pay for it. The shortfall is recorded and written off: it is never invoiced and never deducted from credits you receive later. Marketing sends wait until you have credits again.
12. Refunds
A billing period that has started is not refunded when you cancel. We refund you in full where we charged you in error, where Guestavo was unavailable for a material part of a period through our fault, or where mandatory law requires it.
If we refund an invoice that granted you credits, we take those credits back. If you have already spent some of them, we take back what is left rather than putting your balance below zero. Refunds go back to the payment method you paid with, through the provider you paid through, and can take a few working days to appear. Ask us at info@guestavo.com.
13. When the agreement ends, and what happens to your balances
You can close your account at any time; how we may end the agreement is in the Termination section. When a subscription ends, whichever of us ended it:
- Your data is not deleted. It stays readable and exportable for as long as your organization exists. Losing a paid module turns off writing to it, not access to what is already there, and re-subscribing returns you to exactly where you were, because nothing is archived or renamed.
- Your included credits end with the subscription that granted them. They were part of the plan fee rather than something you bought separately.
- Your purchased credits keep the term they were bought with, 3 months from purchase, and can still be spent until then on any part of Guestavo you have access to. They are not converted to cash, and closing your account ends the right to spend them.
- Anything you owe us and anything we owe you at that moment stays owed.
Deleting your data is always a separate, deliberate action that you take, with its own confirmation. It is never a side effect of a billing event.
14. Right of withdrawal for consumers
Guestavo is sold to businesses, and a business customer has no statutory right of withdrawal. If you are nevertheless a consumer under EU consumer law, buying for yourself rather than for a trade or business, which a sole trader can be, you keep the right the law gives you: you may withdraw from this contract within 14 days of concluding it, without giving a reason, by any clear statement to info@guestavo.com.
The cancellation rights in this document apply to everyone, consumer or not.
15. Limitation of Liability
To the maximum extent permitted by law, Guestavo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
16. Disclaimer
The service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
17. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the service after any changes constitutes acceptance of the new terms.
